Rayong fishing communities and small businesses initiate class action lawsuit against SPRC

The incident, which led to the leakage of at least 50,000 liters of crude oil into the Gulf of Thailand and onto the shores of Rayong on January 25, 2022, has reportedly affected over 2,600 local fishermen.

A group of fourteen people from Rayong’s fishing communities and small businesses has initiated a class action lawsuit against Star Petroleum Refining Company (SPRC), seeking redress for a significant oil spill in 2022 that they argue has devastated their way of life.

The incident, which led to the leakage of at least 50,000 liters of crude oil into the Gulf of Thailand and onto the shores of Rayong on January 25, 2022, has reportedly affected over 2,600 local fishermen. The Rayong Provincial Fisheries Office has reported a severe depletion of fish stocks in the area, rendering much of the local catch unsellable and drastically impacting the fishermen’s income.



Accompanied by Somchai Armeen, chairman of an environmental cases sub-panel at the Lawyers Council of Thailand, the plaintiffs filed their lawsuit at the Civil Court, demanding 4.2 million baht in compensation from SPRC. They claim that the spill has forced many in their community to abandon fishing or to seek fish in more distant waters, significantly altering their traditional livelihoods. The lawsuit also implicates five other entities for violations of environmental protection laws.



The representatives belong to a community known as Pak Nam Ban Rao, which includes over 800 members. A favorable court ruling, scheduled for examination on May 17, could set a legal precedent, potentially opening the door for further compensation claims amounting to around 240 million baht against the company. In addition to legal action, the affected groups have appealed to the government for assistance in rehabilitating the local marine ecosystem, highlighting the broader environmental and economic repercussions of the spill. Thailand finds itself amidst a diverse array of weather phenomena, ranging from scorching heat to thunderstorms and gusty winds across different regions of the country, revealed the Thai Meteorological Department.

The department disclosed that the upper parts of Thailand are currently engulfed in a blanket of intense heat, resulting in exceptionally hot temperatures and clear skies during midday hours. This phenomenon has prompted authorities to issue advisories urging citizens to take necessary precautions to safeguard their health amidst the blistering conditions.



Conversely, in the lower northeastern to eastern regions (including Pattaya City), intermittent thunderstorms and strong winds have been observed. This weather pattern is attributed to the influence of southeasterly and southeasterly winds, which bring moisture from the Gulf of Thailand and the South China Sea, creating conducive conditions for thunderstorm formation.

Furthermore, concerns have been raised about the accumulation of dust and smog in several areas. Experts attribute this phenomenon to weakening winds in these areas, exacerbating the accumulation of pollutants in the atmosphere.



As Thailand grapples with these diverse weather conditions, authorities emphasize the importance of staying vigilant and heeding weather advisories to mitigate any potential risks associated with the extreme weather.

The public is urged to stay informed and take necessary precautions to ensure their safety and well-being during this period of meteorological uncertainty.

Charges against officials relating to “Tak Bai Incident” to be filed in April

Criminal charges will be filed by the end of April in Narathiwat against nine government officials, allegedly responsible for the bloody crackdown on Muslim protesters in the “Tak Bai Incident” in 2004.

A network of lawyers, representing the Muslim Attorney Centre Foundation, the Cross Cultural Foundation, the Justice and Reconciliation Centre of Southern Provinces and the Lawyer Council of Thailand, had previously planned to file charges of illegal detention, murder and negligence on Monday, but they decided to postpone the filing until the end of April because some of their witnesses are not either ready or remain in Malaysia.

The incident occurred on October 25th, 2004 during a protest by some 1,500 Malay Muslims, in front of the Tak Bai district police station in Narathiwat, against the detention of six men. When the crowd attempted to cross the police barrier and enter the station, they were met with a barrage of tear gas and water cannons. The crowd responded by throwing stones. Police fired into the air and then at the protesters, killing seven.

Almost 1,300 protests were detained at the scene, but 78 died of suffocation or organ failure after being stacked on top of each other in trucks for a five-hour journey to the Inkayut army camp in Pattani province.

According to the lawyers, the legal action against the nine officials is intended to restore justice to relatives of the deceased, since the police have been reluctant to file charges against them, claiming that they could not identify the perpetrators.

The statute of limitations on the case will expire in the next few months, hence the need to file the charges as a matter of some urgency.
